A rather long history of the mining industry in Australia has resulted in that she has acquired functions of an outstanding innovator in the field of mining. Australia is in the lead in the estimation methods of mineral deposits and in the questions of technology of their processing, improvement of mining equipment and the scientific analysis of technologies. 60% of world discoveries in the sphere of software belong to Australian companies. Innovations of Australia also include automatic system of drilling maps drawing, new methods of restoration of mineral deposits and two-way integrated system by force majeure.

Revealing of the given dependence is an unsolved scientific problem till now which can be referred to the category of fundamental, interdisciplinary problems. If it were simple, it would probably be solved long ago. It is not the matter of poor financing of science, as banks will always have money for solving tasks, which they are interested in. The complexity of the problem is caused by many factors, among which the group of system factors following from the theory of complex economic-organizing systems and system analysis has determining significance.

The article contains the opinion of the author on the informational conditions of the market of capitals and on the behavior of investors, the understanding of sharing of capital issues yield under the influence of financial investment risk is added and formalized. A new approach in active management of financial investments is developed and experimentally tested. The given approach correctly excludes a not existing in practice opportunity of no risk investments, allows to take into account the features of thinking and behavior of market subjects as well as to make reasoned and safe decisions on sale and purchase of capital issues.

Alexey MAKSUROV. Protection of the property right from unreasonable intervention of the state in rights of the proprietor in the European court of human rights
The given cases are not numerous, however they are rather interesting. On estimate of the author they make only 2,6% from all the cases about protection of the property right considered by the European court of human rights. Approximately in 17% of cases complaints of such a type are admitted unacceptable and not communicated to states-respondents. From amount of cases considered in essence about 80% - are satisfied. Unfortunately, these cases almost never end by amicable agreement, and the information on real execution of court decisions in documents of the European court of human rights? is not enough.
